Pickle fans, here’s how to make your claim.

Wahlburgers has been on a roll since opening its first burger restaurant in 2011, and it’s only been getting bigger. Previously exclusive to standalone brick-and-mortar locations, the brand has since expanded to retailers, securing partnerships with Hy-Vee and the Mall of America.

More recently, it took a step further by launching Wahlburgers at Home, a grocery collection featuring the brand’s burger patties, bacon, and a variety of burger toppings. One standout product has been the Wahlburgers pickles. However, those pickles are now at the center of a class action lawsuit over potentially misleading labeling.

The $2 Million Wahlburgers Pickles Lawsuit

According to Top Class Actions, Wahlburgers has agreed to settle a $2 million class action lawsuit, though the company has not admitted any wrongdoing. The pickle packaging stated the product was “fresh,” “all-natural,” and contained “no preservatives.” However, the lawsuit alleges that those same Wahlburgers pickles contained sodium benzoate.

The National Institutes of Health (NIH) states that sodium benzoate is frequently used in various foods to extend shelf life and prevent mold growth. The Code of Federal Regulations notes that this compound is not a naturally occurring preservative.

This isn’t the first time Patriot Pickle, the manufacturer of Wahlburgers pickles, has been under scrutiny. According to a 2023 press release, Grillos Pickles filed a complaint accusing Patriot Pickle of using artificial preservatives in Wahlburger pickles despite their labeling indicating otherwise. Ultimately, Patriot Pickle admitted in court filings that the pickles did contain the artificial preservative sodium benzoate and ensured it would be removed from Wahlburgers pickles production moving forward.

How to File A Claim in the Lawsuit

If you purchased Wahlburgers Fresh Dill Spears, Fresh Dill Chips, or Fresh Dill Chips Hot between April 1, 2021, and March 31, 2023, you may be eligible for reimbursement.

If you do not have proof of purchase—Class members can receive $2 per container of pickles purchased. You may claim up to six undocumented purchases, for a total of $12.

If you have proof of purchase—Class members can receive full reimbursement for every container of pickles for which they can provide documentation.

Be sure to file a claim online by July 29, 2024, to receive settlement benefits.

And, if you’re not one to hold onto receipts, check your store loyalty apps, as many keep a record of your purchases.
