CANAL WINCHESTER, Ohio (WCMH) — The housing supervisor for a sober living apartment who was accused of forcing his tenant to perform a sex act to avoid eviction was sentenced to 36 months in prison.
Charles R. Smith Jr. pleaded guilty to one count of sexual battery on June 10, a lesser offense in exchange for the felony rape charges he was charged with initially.
Smith was sentenced to 36 months, or three years, in prison, followed by a mandatory five years of post-release control. He will also have to register as a Tier III sex offender for life.

Smith was not fined as he was declared indigent, or lacking sufficient funds to pay for court costs or basic necessities. Court documents said it was also determined he will receive jail credit for the more than nine months he has already served.
Smith was arrested in October 2023 after a tenant alleged he prevented her from leaving a meeting with him. The tenant said he then told her she had to perform a sexual act on him if she wanted to continue living there and started getting angry, according to the affidavit. The victim said she feared for her safety so she performed the act
