Emergency row: Bombay High Court declines immediate relief for Kangana Ranaut’s film amid certification delay : Bollywood News – MASHAHER

Kangana Ranaut’s upcoming film Emergency has faced another setback as the Bombay High Court has said that it cannot direct the Central Board of Film Certification (CBFC) to issue a certificate to the movie as that would contradict a court order by the Madhya Pradesh High Court. This decision comes amidst objections from Sikh organizations, which have delayed the film’s clearance and release.

Emergency row: Bombay High Court declines immediate relief for Kangana Ranaut’s film amid certification delay

Emergency, co-produced by Kangana Ranaut’s Manikarnika Films and Zee Studios, was originally on track for release after incorporating CBFC’s suggested modifications. But the certification was paused following concerns raised by Sikh groups, who believe the film misrepresents their community.

However, despite the decision by the Bombay High Court, Kangana has claimed a victory in court. She wrote on X, “High court has blasted censor for illegally withholding the certificate of #emergency.”

Emergency had initially moved forward after incorporating the CBFC’s suggested modifications. However, the certification process was paused following concerns raised by Sikh groups regarding the film’s portrayal of their community.

The film, which focuses on the Emergency period of 1975 under the then Prime Minister Indira Gandhi’s government, has stirred controversy due to its depiction of Sikh characters. The Shiromani Gurdwara Parbandhak Committee, a significant Sikh religious body, voiced objections, leading to a Public Interest Litigation (PIL) in the Madhya Pradesh High Court. The court responded by directing the CBFC to consider these objections before proceeding with certification.

In an effort to expedite the certification, Zee Entertainment Enterprises approached the Bombay High Court. Senior Advocate Venkatesh Dhond argued that the CBFC’s role is limited to censoring content, not addressing potential law and order issues. He pointed out that the film had been adjusted according to the CBFC’s guidelines and should be allowed to proceed to release.

However, CBFC’s counsel, Advocate Abhinav Chandrachud, argued that the certification process was still incomplete. He noted that the Bombay High Court could not override the Madhya Pradesh High Court’s directive. The court agreed, stating that ordering the CBFC to issue a certificate would conflict with the Madhya Pradesh High Court’s ruling.

The Bombay High Court has instructed the CBFC to consider all objections and representations from Sikh organizations by September 19. With the court choosing not to intervene at this stage, the release of Emergency remains on hold. Initially scheduled for release on September 6, the film has been postponed.
